Agreement to Terms

These Terms of Service ("Terms") govern your use of the website and mobile applications operated by Offensive Threads LLC under the App Drafting Labs brand ("Company," "we," "us," or "our"), including FossilFinder Pro and any other apps we publish (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Use of Services

Our Services are provided for personal, non-commercial use unless otherwise agreed in writing. You agree to use the Services only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Services for any unlawful or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble any part of the Services
• Interfere with or disrupt the integrity or performance of the Services
• Upload malicious code, spam, or harmful content
• Impersonate any person or entity or misrepresent your affiliation
• Use automated systems to access the Services without our permission

Accounts & Subscriptions

Some features may require account registration or a paid subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Subscription terms, pricing, and renewal are governed by the Apple App Store terms and your selected plan.

User Content & Photo Uploads

You retain ownership of content you create within our apps, including photos (captured in-app or selected from your device photo library), logbook entries, and notes. By using FossilFinder Pro's AI identification or cloud sync features, you grant us a limited, non-exclusive license to process your uploaded photos and associated data solely to provide the requested Services (including AI analysis via Google Gemini and secure storage via Supabase).

You represent that you have the right to upload any photos or content you submit and that such content does not violate any third-party rights or applicable laws.

Intellectual Property

The Services, including all content, features, functionality, software, design, text, graphics, and logos, are owned by Offensive Threads LLC and are protected by copyright, trademark, and other intellectual property laws.

AI Identification Disclaimer

FossilFinder Pro provides AI-assisted fossil and specimen identification suggestions powered by Google Gemini. These results are informational and educational in nature and should not be considered definitive scientific identification. We make no guarantees regarding the accuracy of AI-generated identifications. Always consult qualified professionals for scientific, commercial, or legal purposes.

Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information — including photos, location data, and logbook content. We do not sell your personal information to data brokers.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFFENSIVE THREADS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Offensive Threads LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
